Individual note holder – reached settlement on defaulted demand note within two weeks of filing complaint as a result of successfully obtaining ex parte pre-judgment attachments against borrowers.

Mortgage lender – obtained temporary restraining order for client approximately 3 hours after it received a cease and desist order from state regulator, which order was issued in violation of client’s due process rights.

MA Wage Act – obtained pre-judgment trustee process attachments against employer’s and president’s personal bank accounts and won motion to compel full wage payment that employer claimed was subject to a set-off

MA Wage Act – obtained summary judgment in favor of employee against Massachusetts employer where employee lived out of state.  For a copy of the decision, click here.

Personal Injury – obtained largest jury verdict in Massachusetts in 2004 in case where plaintiff was paralyzed after being rear-ended by tractor-tanker.

Invasion of privacy – brought and defended privacy claims arising out of camera in workplace bathroom in jury trial resulting in judgment for company.

Slander – obtained jury verdict against supervisor who made comments regarding employee in meeting regarding the review of her credentials to operate at Brigham & Women’s Hospital.

Unfair Business Practices/Consumer Protection

G.L. ch. 93A/176D – obtained double damages against insurer for unfair insurance practices, resulting in a $22.7 million verdict Rhodes v. AIG.PDF

  • represented international real estate brokerage and management company in Suffolk Superior Court action seeking payment for identifying tenant who signed letter of intent for space in downtown Boston location that was ultimately sold to New York investors.  Obtained court order in December 2012 requiring purchaser to hold $886,000 from sale proceeds as security for Pinkham Busny LLP’s client.  Case quickly settled on favorable terms.
